Legal Basis is given to the Energy Resource and Development Bureau to regulate this commodity via RA 7638 (Creation of the Dept. of Energy) and Sec. 60(a)(1), DENR AO 14 series 1993.

Certificate of Compliance or Coal Export Certificate

Documentary Requirements Procedure Lead Time Processing Fee

Registered importers & exporters are required to submit prior notice for every importation and exportation:

  1. 1.) Written notice addressed to the ERDB prior to actual loading of every importation inluding details and/or accompanying documents related to the importation:
    1. a.) type and quantity of cargo;
    2. b.) Estimated date of loading and arrival;
    3. c.) Supplier of Cargo;
    4. d.) Estimated FOB price, freight and insurance cost;
    5. e.) Vessel particulars;
    6. f.) Ports of loading and discharge
  2. 2.) Documents to be attached to the written request:
    1. a.) Proforma Invoice
    2. b.) Guaranteed specification of the product

All applications for tax-exempt importations shall be made upon BED-L-Coal-1 which shall be accomplished in triplicate and sworn by a responsible officer of the operator before a notary public.

  1. 1.) Applicant submits written request for Certicate of Compliance (COC) for importation purposes and Coal Export Clearance (CEC) for exportation purposes;
  2. 2.) Evaluation/processing of application & preparation of Memorandum of Approval and COC/CEC. Note: CEC- processing requires DOE site verification of coal export shipment at the applicant's place of business/warehouse;
  3. 3.) Review/ endorsement for approval of MOA & COC/CEC- Director & Undersecretary;
  4. 4.) Recording & Release of MOA and COC/CEC to Applicant/BOC;
  5. 5.) DOE follow-up on post-shipment documents submission of import/export. Note:COC- post evaluation requires DOE site verification of coal import shipment at the applicant's place of business/warehouse

Tax-Exempt Importation

  1. 1. Submission of Application for Tax-exempt importation w/ attach purchase order(BED-L-Coal-1)
  2. 2.Evaluation/processing /endorsement of application for approval
  3. 3. Granting of Certificate of Qualification for Tax-Exemption (BED-L-Coal-2)

Copy of Post shipment documents will be submitted ten (10) days after the arrival of import & export shipments to the DOE for verification/record purposes:

  1. 1.) Bill of Lading;
  2. 2.) Import Entry;
  3. 3.) Commercial Invoice;
  4. 4.) Release Certificate;
  5. 5.) Certificate of Quality particularly the BTU of the product received;
  6. 6.) Other documents related to the above importation

Within 30 days following the release of the importation from customs custody, the operator shall submit to the BED copies of official documents required under the Revised Tariff and Customs Code of the Phils

Normal processing time would take of three (3) working days as enumerated in the service guide manual of the DOE.

  • 1.) COC (Import): Permit Fee - Php 650 & Application Fee - Php 650 ;
  • 2.) CEC (Export): Permit Fee- Php 1,300

Tax Exempt Certificate (TEC-DOE Form No. 4)

  1. 1. Properly filled-up application form (Form No. 3) sworn by a responsible officer of the applicant before a notary public.
  2. 2. Commercial Invoice/Packing List/Purchase Order
  3. 3. In case of emergency purchase, letter of request with reasons
  4. 4. Post bond in favor of the BOC in an amount equivalent to 150% of the estimated duties and taxes due on the importation

Processing fee of Php 300.00/application included in the application form are certifications that the machinery, equipment, spare parts and materials are not manufactured domestically; that they are directly and actually needed and will be used exclusively by the service contractor it its operations; and that the items are in the name of the contractor.

  1. 1. SC holder to accomplish DOE Form No. 3.
  2. 2. Application with complete requirements to Contract Negotiations Division for numbering.
  3. 3. Payment of processing fee at DOE Cashier.
  4. 4. TEC application to PRDD for technical evaluation.
  5. 5. PRDD to prepare memorandum to CND recommending/endorsing approval of the application.
  6. 6. CND to prepare authority for importation (DOE Form No. 4).
  7. 7. Authority for imporation to be signed by ERDB Director after approval by the Undersecretary (DOE Secretary if fuel or vehicle).
  8. 8. CND releases the auhority
  9. 9. DOE Records Section transmits the authority to SC holder.

DOE Secretary's clearance is required if fuel or vehicles under D.O. 2005-12-022
